Welcome to Fauna, operated by Dgitalstack Ltd. ("we," "us," "our"). By downloading, installing, accessing, or using the Fauna mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
You must be at least 13 years old to use the App. If you are between 13 and 18 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under 13.
Fauna is an AI-assisted nature identification and field journal app. The App allows you to photograph organisms, receive AI-generated species identifications, maintain a personal sighting journal, track collections, and earn badges. Fauna uses artificial intelligence (Google Gemini) to analyze images and provide species information. The App is designed for educational and recreational purposes only.
The App is provided for personal, non-commercial use only. You may use species identifications, journal entries, and other App content for your own educational, recreational, and personal reference purposes. You may not use the App, its data, or its outputs for any commercial purpose, including but not limited to: paid consulting or identification services, commercial surveys or environmental assessments, reselling or redistributing identification results, or building datasets for third-party products. We reserve the right to restrict or terminate access for any use we reasonably determine to be outside the intended scope of the App.
Fauna does not require traditional user accounts with usernames or passwords. Instead, an anonymous identifier is used to manage your activity within the App. If you delete the App or clear its data, your identifier and all locally stored data (journal entries, badges, collections) will be permanently lost and cannot be recovered. We are not responsible for any data loss, whether resulting from device changes, App deletion, storage clearing, device failure, operating system updates, or any other cause.
Species identifications, confidence scores, descriptions, conservation statuses, risk levels, and all other information provided by the App are AI-generated and may contain errors. Confidence scores are informational indicators and do not represent a statistical guarantee of correctness. Low-confidence results explicitly indicate uncertainty, but even high-confidence results may be incorrect.
You must never rely on the App to determine whether a species is safe to touch, handle, consume, or approach. The App does not reliably identify venomous, toxic, poisonous, or otherwise dangerous organisms. You are solely responsible for your own safety when interacting with wildlife, plants, fungi, or any organism in nature. Always consult authoritative field guides, local wildlife authorities, or qualified experts before handling or consuming any organism.
Nature activities carry inherent risks including but not limited to encounters with dangerous wildlife, hazardous terrain, adverse weather, and allergic reactions. By using the App in outdoor settings, you acknowledge and voluntarily assume all risks associated with your outdoor activities. Fauna is not responsible for any injury, illness, property damage, or death arising from your interactions with wildlife or nature, regardless of whether you relied on information provided by the App.
The App does not provide professional scientific, medical, veterinary, ecological, or safety advice. Information provided should not be used as a substitute for consultation with qualified professionals. Do not use the App for academic research, regulatory compliance, environmental assessments, or any context requiring verified species identification.
Fauna is designed to promote appreciation and understanding of nature. You must use the App responsibly and in compliance with all applicable wildlife protection, conservation, and environmental laws. You must not use the App or any information obtained from it to: locate, track, capture, hunt, poach, or trade in any wildlife species; disturb, harass, or interfere with any animal, nest, habitat, or protected area; violate any endangered species legislation, wildlife protection laws, or conservation regulations, including but not limited to the Endangered Species Act, CITES, or equivalent legislation in your jurisdiction; or facilitate any commercial exploitation of wildlife. Fauna does not condone and expressly prohibits any use of the App that contributes to harm against wildlife or natural habitats. We are not responsible for any user's conduct in nature, including any actions taken based on species identification or location information provided by the App. We reserve the right to terminate access for any user we reasonably believe is using the App in connection with illegal wildlife activity.
You retain full ownership of all photos and content you submit through the App.
By submitting photos or content through the App, you grant Fauna a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, process, analyze, and display your content for the purposes of: (a) providing the App's services to you; (b) improving species identification accuracy; (c) building and maintaining our visual species database; and (d) conducting anonymized ecological research. Your photos may be processed by third-party AI services for identification purposes. We do not sell, sublicense, or distribute your photos to third parties outside of these purposes.
If you submit species corrections or feedback through the App's reporting system, your corrections are stored and may be used to improve identification accuracy. Corrections are associated with your anonymous device identifier, not your personal identity. We are not liable for any inaccuracies in the identification system arising from user-submitted corrections, whether submitted in good faith or otherwise.
You represent and warrant that: (a) you own or have the necessary rights to all content you submit; (b) your content does not infringe any third-party intellectual property, privacy, or other rights; and (c) your content does not contain malicious code, illegal material, or misleading information.
Free users receive a limited number of species identification scans per calendar day. Failed scans due to system errors do not count toward your daily limit. Unused daily scans do not roll over. Free users have access to a selection of starter collections.
Fauna Pro is available as a monthly or annual auto-renewable subscription, each with a free trial period. Current pricing is displayed in the App Store at the time of purchase. Fauna Pro provides access to all collections, the ability to import past photos, and removal of the daily scan limit. While Fauna Pro removes the daily scan cap, usage remains subject to third-party rate limits. In rare cases of exceptionally high volume, you may experience temporary throttling. We do not guarantee any specific number of scans per day for Fauna Pro users.
The Explorer Pack is a one-time, non-refundable in-app purchase that unlocks an additional collection and adds bonus scans to your account. Current pricing is displayed in the App Store at the time of purchase. Bonus scans persist until used and do not expire, but are consumed after your daily free scans are exhausted. Bonus scans are non-transferable and non-refundable.
All payments are processed through Apple's App Store. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period. You can manage and cancel subscriptions through your Apple ID account settings. No refunds are provided for partial billing periods. Refund requests should be directed to Apple per their App Store policies.
If you start a free trial, you will not be charged during the trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription at the applicable rate. Free trial eligibility is determined by Apple and is typically limited to one trial per Apple ID.
Fauna Pro subscribers may import photos from their device's photo library for identification during a limited import window beginning on their first subscription activation. This window does not reset if the subscription lapses and is reactivated.
If your Fauna Pro subscription expires or is cancelled, you will retain access to your existing journal entries and sightings, but features exclusive to Fauna Pro (including premium collections and unlimited scans) will no longer be available. Sightings previously logged under premium collections will remain in your journal but may be displayed with limited functionality. Badges and ranks earned during your subscription period are yours to keep permanently and will not be revoked.

The App, including its design, code, features, species database, collection systems, badge designs, icons, and all associated content (excluding user-generated content), is owned by Fauna and protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works from any part of the App without our prior written consent. "Fauna" and associated logos are trademarks of Fauna.
We reserve the right to modify, suspend, or discontinue any part of the App at any time, with or without notice, including adding or removing features, changing subscription offerings, or updating the species identification system. We are not liable to you or any third party for any modification, suspension, or discontinuation of the App or any of its features.
The App relies on third-party services to provide certain features, including species identification, payment processing, and data storage. We do not control the availability, accuracy, or performance of these third-party services and are not responsible for any disruption, error, or change in their operation. Changes to third-party services may affect the availability or functionality of certain App features.
THE APP IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT: (A) THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE; (B) SPECIES IDENTIFICATIONS WILL BE ACCURATE OR RELIABLE; (C) ANY INFORMATION PROVIDED BY THE APP IS COMPLETE OR CURRENT; OR (D) THE APP WILL MEET YOUR SPECIFIC REQUIREMENTS.
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL FAUNA, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOSS OF DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR USE OF OR INABILITY TO USE THE APP; (B) ANY SPECIES IDENTIFICATION, SAFETY INFORMATION, OR OTHER CONTENT PROVIDED BY THE APP; (C) YOUR INTERACTIONS WITH WILDLIFE, PLANTS, FUNGI, OR ANY ORGANISM; (D) ANY UNAUTHORIZED ACCESS TO YOUR DATA; OR (E) ANY THIRD-PARTY CONDUCT OR CONTENT. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify, defend, and hold harmless Fauna, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the App; (b) your violation of these Terms; (c) your interactions with wildlife or nature; (d) content you submit through the App; or (e) your violation of any third-party rights.
We reserve the right to suspend or terminate your access to the App at any time, with or without cause, including for violation of these Terms or abuse of the correction/reporting system. Upon termination, your right to use the App ceases immediately. Provisions that by their nature should survive termination shall survive, including the License Grant, Disclaimer of Warranties, Limitation of Liability, Indemnification, and Governing Law sections.
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, acts of government, internet or infrastructure outages, third-party service disruptions, pandemics, or other events of force majeure.
We may update these Terms from time to time. If we make material changes, we will notify you through the App or by other means prior to the changes taking effect. Your continued use of the App after changes become effective constitutes acceptance of the revised Terms. If you do not agree to the updated Terms, you must stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in Toronto, Ontario, in accordance with the Arbitration Act, 1991 (Ontario). To the extent permitted by applicable law in your jurisdiction, you agree to waive any right to participate in a class action lawsuit or class-wide arbitration. Nothing in this section limits any rights you may have under mandatory consumer protection laws in your jurisdiction.
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision shall be effective only if in writing and signed by us.
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in connection with a merger, acquisition, sale of assets, or by operation of law.
If any provision of these Terms is held to be invalid or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fauna regarding your use of the App and supersede all prior agreements and understandings.
